The Dutch Personal Data Protection Act
All processing of personal data will take place in accordance with the Dutch Personal Data Protection Act (Wet Beveiliging Persoonsgegevens, or WBP). This law helps protect the privacy of citizens. All personal information which by means of the internet is gathered, saved, used, protected, made available, or linked with other data falls under this legislation.
The WBP requires that prior to processing personal data, the individual to whom it relates must first be informed what will be done with their data and for what purpose it has been gathered. Personal information is thus only processed if that has been explicitly communicated and if the reason for saving the information has been indicated.
Personal information
Personal information is taken to mean information that can be traced back to an “identified or identifiable person”, meaning that the name of the individual to whom the information refers is known or can be determined. Examples of personal information include an individual’s name or home address, but an email address can also be personal information.
